1. Introduction
This Privacy Policy describes how Esperian Interactive LLC ("Esperian Interactive," "we," "us," or "our") collects, uses, shares, and protects your information when you use the In-Tune Moto mobile applications, websites, APIs, and related services (collectively, the "Service").
By accessing or using the Service you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Service.
2. Definitions
Account: A unique account created for you to access the Service.
Application: In-Tune Moto, provided by Esperian Interactive LLC.
Cookies: Small files placed on your device by our website or app to store preferences and analytics data.
Personal Data: Any information that relates to an identified or identifiable individual.
Service Providers: Third parties that process data on our behalf to help us operate, analyze, or improve the Service.
Usage Data: Data collected automatically through analytics and diagnostic tools.
You: The individual accessing or using the Service, or the entity on whose behalf such individual is using the Service.
3. Information We Collect
Account Information: email address, display name, and optional profile details you provide, such as vehicle and gear details.
User Content: photos, images, videos, audio recordings, ride logs, notes, event listings, RSVPs, messages, comments, group information, and other media that you choose to create, upload, or share through the Service. Content you share with other users or groups may be visible to them.
Subscription and Purchase Data: if you buy an optional paid subscription ("Pro" or similar), the Apple App Store or Google Play processes your payment. We and our subscription processor, RevenueCat, receive your subscription and entitlement status (such as whether a subscription is active or expired); we do not receive your full payment card number.
Store, Order, and Payment Data: if you buy real-world goods or services through the Service (such as event tickets, merchandise, memberships, or sponsorships), our payment processor, Stripe, processes your payment. We and the selling business receive order details such as the items purchased, amount, order and ticket status, and, where relevant to fulfillment, a shipping or contact address. Your payment is handled by Stripe; we do not collect or store your full payment card number.
Seller and Payout Data: if you set yourself up as a business to sell through the Service, you and Stripe provide and process information needed to onboard you for payouts and to meet legal requirements - which may include your business or legal name, contact details, tax identification number, and bank or payout account details. Stripe collects and verifies much of this directly under its own agreements; we receive payout, identity-verification, and tax-reporting status and summary transaction data, but not your full bank account or card numbers.
Usage and Device Data: device model, operating system, unique device and advertising identifiers, app interactions, crash logs, IP address, and analytics metrics.
Location and Map Data: precise or approximate location, collected only when you grant permission and use features that rely on it (such as ride tracking, venue and address search, maps, and navigation). When you use these features, queries and approximate location may be processed by our mapping providers (see Section 7). Location is not accessed in the background unless you explicitly enable a feature that requires it, and you may revoke this permission at any time in your device settings.
Camera, Photo, and Microphone Data: collected only when you grant permission and actively use features that require capturing or selecting photos, video, or audio. The camera and microphone are never accessed in the background, and you may revoke these permissions at any time in your device settings.
Communications and Notifications: information you provide when you contact us for support or send feedback, and information used to send you push notifications, in-app messages, and emails about events, RSVPs, messages, group activity, security, and your account.
4. How We Use Your Information
We use the information we collect to: operate, maintain, and improve the Service; create and manage your account; process subscriptions and manage entitlements; process payments, orders, tickets, refunds, and seller payouts and facilitate transactions between buyers and selling businesses; enable community features such as events, RSVPs, messaging, and groups; provide customer support; personalize your experience; send notifications and service-related communications; serve and measure advertising where offered; analyze usage and diagnose technical issues; detect, prevent, and address fraud, abuse, or security incidents; comply with legal obligations; and communicate with you about updates, features, and promotions.
5. Legal Bases for Processing (EEA/UK Users)
Where the EU or UK General Data Protection Regulation applies, we process your Personal Data on the following legal bases: performance of a contract (to provide the Service and process subscriptions); your consent (for optional permissions such as camera, photos, microphone, location, and personalized ads); our legitimate interests (to secure, analyze, and improve the Service); and compliance with legal obligations.
Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.
6. Service Providers and Infrastructure
We use Google Firebase for authentication, database and storage, crash reporting, and analytics, and Amazon Web Services and Google Cloud for hosting and infrastructure. We use RevenueCat as a subscription processor solely to validate purchase receipts and synchronize entitlement state; RevenueCat does not access your payment details. We use Stripe to process payments for real-world goods and services, to onboard sellers, to disburse seller payouts, and to support fraud prevention and tax reporting; Stripe processes this information both as our Service Provider and, for sellers, as an independent payment service provider under its own agreements and privacy policy. Data is encrypted in transit and at rest and may be processed in the United States and other regions. These providers process data as our Service Providers in accordance with their terms and privacy policies, including the Google Privacy Policy.
7. Maps and Location Providers
The Service uses third-party mapping, location, and geocoding providers, including Google Maps and OpenStreetMap, to display maps, search for venues and addresses, and enable navigation. When you use these features, information such as your search queries and approximate location may be sent to and processed by these providers under their own terms. Your use of Google mapping features is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Mapping and geocoding data provided through OpenStreetMap is © OpenStreetMap contributors, made available under the Open Database License.

8. Advertising and Analytics
We may use Google AdMob to serve ads and Firebase Analytics to understand user engagement. Advertising may not be present in every version of the Service. These services may collect device identifiers, ad interactions, and app usage metrics.
Where advertising is enabled, Google AdMob may use cookies and advertising identifiers (IDFA, AAID) to deliver and measure personalized ads. You can opt out of personalized ads through Android Google Settings > Ads > Opt out of Ads Personalization, or iOS Settings > Privacy & Security > Apple Advertising > Personalized Ads / Allow Apps to Request to Track.

9. How We Share Information
We do not sell your Personal Data, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law.
We may disclose information to: Service Providers (such as Google Firebase, Google Cloud, Amazon Web Services, RevenueCat, Stripe, and our mapping providers, and—where advertising is enabled—Google AdMob) who process data on our behalf; selling businesses, where you place an order, buy a ticket, or otherwise transact with them, so they can process, fulfill, and provide support for that purchase (such as order details and any shipping or contact information you provide); other users, where you choose to share content such as event listings, messages, group information, or profile details; law enforcement or other parties when required by law or to protect rights and safety; and a successor entity in connection with a merger, acquisition, or sale of assets, subject to this Privacy Policy.
When you transact with a selling business through the Service, that business acts as an independent controller of the order information it receives and is responsible for its own use of that information; we encourage you to review the business's own practices.
10. Cookies and Tracking Technologies
We and our partners use cookies, SDKs, and similar technologies to operate the Service, remember preferences, and measure performance. You can adjust cookie preferences in your browser or device settings and limit ad tracking as described in Section 8.
11. Data Retention
We retain Personal Data only as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we delete or anonymize it.
12. Account Deletion and Your Choices
You can delete your In-Tune Moto account directly in the app by opening the Profile tab, opening the Settings menu, and selecting Delete Account.
You can also request deletion of your account and associated app information by emailing support@esperianinteractive.com. Account deletion requests are processed within 3 business days.
You can manage permissions (camera, photos, microphone, location, notifications) and ad personalization at any time through your device settings.
13. Your Privacy Rights
Depending on where you live, you may have the right to access, correct, update, port, restrict, or delete your Personal Data, to object to certain processing, and to withdraw consent.
EEA/UK Residents (GDPR): you have the rights described above and the right to lodge a complaint with your local data protection authority.
California Residents (CCPA/CPRA): you have the right to know what Personal Data we collect, use, and disclose; the right to delete and correct it; the right to opt out of sale or sharing (we do not sell or share Personal Data); and the right not to be discriminated against for exercising your rights.
To exercise any of these rights, email support@esperianinteractive.com. We will verify your request and respond within the time required by applicable law. You may use an authorized agent where permitted.
14. International Data Transfers
Your information may be stored and processed in the United States or other countries through Amazon Web Services, Google Cloud, and our other Service Providers. Where required, we rely on appropriate safeguards, such as Standard Contractual Clauses, to protect data transferred internationally.
15. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect Personal Data from children under 13. If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian. Ads are not personalized for minors. If you believe a child has provided us Personal Data, contact us and we will delete it.
16. Security
We use TLS encryption, authentication controls, and secure Amazon Web Services and Google Cloud storage to protect your data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
17. Third-Party Links and Services
The Service may contain links to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies.
18. Legal Disclosures
We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with a legal obligation, protect our rights or property, prevent wrongdoing, or protect the safety of users or the public.
19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will revise the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised policy.
